Terms of service

Last updated: October 17, 2026

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY. SECTION 22 CONTAINS A BINDING ARBITRATION AGREEMENT AND WAIVERS OF CLASS ACTIONS AND JURY TRIALS. UNLESS YOU OPT OUT WITHIN 30 DAYS (SECTION 22.12), YOU AND VINTAGE MUSCLE WILL RESOLVE MOST DISPUTES THROUGH INDIVIDUAL ARBITRATION, NOT IN COURT. THESE TERMS ALSO CONTAIN AUTOMATIC-RENEWAL TERMS FOR AUTOSHIP SUBSCRIPTIONS (SECTION 10), HEALTH AND SAFETY WARNINGS (SECTION 3), A DISCLAIMER OF WARRANTIES (SECTION 18), AND A LIMITATION OF LIABILITY (SECTION 19).

Key points. This short summary helps you find the most important terms. It does not replace the full Terms below, which control.

  • You must be at least 18 years old to buy or use our products (Section 2).
  • Our products are sold as dietary supplements, not FDA-approved drugs. Talk to your doctor before you use them. Some contain ingredients that are banned in drug-tested sports and restricted for military members (Section 3).
  • You must follow the laws where you live. Some states and countries restrict certain supplement ingredients (Section 4).
  • AutoShip subscriptions renew and charge your payment method automatically until you cancel. You can cancel online at any time (Section 10).
  • The first time you buy a product, our 30-Day Money-Back Guarantee covers the first bottle, even if you opened it. Contact us within 30 days after delivery and return the bottle at your cost. We do not refund shipping charges (Section 9).
  • Disputes go to individual arbitration under consumer rules of the American Arbitration Association, with an exception for small claims court. You can opt out within 30 days (Section 22).
  • Utah law governs these Terms (Section 23).

1. About These Terms

1.1 Who we are. The website www.vintage-muscle.com is operated by Van Yperen Sites LLC, a Utah limited liability company doing business as Vintage Muscle ("Vintage Muscle," "we," "us," or "our"). Our address is 909 South Main Street, Suite F, Logan, Utah 84321, USA. In these Terms, "you" and "your" mean the person who visits our website or buys from us. "Services" means our website and all of its pages, our checkout, customer accounts, the AutoShip subscription portal, our emails and text messages, our customer support, and any other website, page, tool, or channel that we operate and that links to these Terms. "Products" means the products we sell. "Vintage Muscle Parties" means Vintage Muscle and its owners, members, managers, officers, employees, agents, contractors, affiliates, licensors, suppliers, and service providers.

1.2 How you accept these Terms. These Terms of Service ("Terms") are a legally binding contract between you and Vintage Muscle. You accept these Terms, and agree to be bound by them, when you do any of the following: (a) check a box or click a button that states that you agree to these Terms, such as at checkout; (b) place an order; (c) create an account; (d) start an AutoShip subscription; (e) sign up for our emails or text messages; or (f) access or use the Services after these Terms are posted. If you do not agree to these Terms, do not use the Services and do not buy our Products.

1.3 Other policies that are part of these Terms. The following are part of these Terms and are incorporated by reference: our Privacy Policy, Refund Policy, 30 Day Money Back Guarantee Policy, Cancellation Policy, and Disclaimer, and any terms that we show you at checkout, on a product page, or for a specific promotion, contest, or program (together, "Additional Terms").

1.4 Order of precedence. If these Terms conflict with any Additional Terms, these Terms control, unless the Additional Terms expressly state that they control over a specific Section of these Terms. Section 9 controls over any conflicting term in our Refund Policy or our 30 Day Money Back Guarantee Policy. Section 10 controls over any conflicting term in our Cancellation Policy. Section 22 (Dispute Resolution) controls over any dispute-resolution term in any other policy or Additional Terms.

1.5 Acceptance limited to these Terms. If these Terms are considered an offer, acceptance is expressly limited to these Terms. We reject any different or additional terms that you propose, including in any purchase order or other communication.

1.6 Effective date for existing customers. If you accepted an earlier version of these Terms, this version applies to you starting 30 days after the "Last updated" date above, or sooner if you accept it before then (for example, at checkout). Until then, the earlier version continues to apply to you.

2. Eligibility and Age Requirement

2.1 You must be 18 or older. You must be at least 18 years old, and old enough to form a binding contract where you live, to use the Services, create an account, or buy, receive, or use our Products. When you use the Services or place an order, you represent that you meet these requirements, that applicable law does not prohibit you from receiving our Products, and that we have not previously suspended or banned you from the Services.

2.2 No sales to or use by minors. Our Products are for adults only. You may not buy Products for, give or sell Products to, or allow the use of Products by anyone under 18. If you buy Products for another adult, you must give that person the product label and the warnings in these Terms.

2.3 Age verification. We may verify your age at any time, including at checkout or at delivery. We may use a third-party age-verification service, require an adult signature and valid government-issued photo ID at delivery, or use other reasonable methods. Where the law requires it (for example, for deliveries to New York), an adult must sign for the package and show valid government-issued photo ID. Some carriers require the person who signs to be 21 or older. If we cannot verify that you are at least 18, we may cancel your order and refund you.

2.4 Children's privacy. The Services are not directed to children. We do not knowingly collect personal information from children under 13. If you believe that a child has given us personal information, contact us and we will delete it.

3. Health and Safety

Read this Section and every product label before you use any Product.

3.1 Dietary supplements, not drugs. Our Products are sold as dietary supplements. They are not FDA-approved drugs. The U.S. Food and Drug Administration (FDA) does not approve dietary supplements before they are sold. These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.

3.2 No medical advice. Everything we provide through the Services is general information only. This includes product descriptions, articles, videos, emails, texts, social media posts, coaching or training guidance, answers from customer support, and statements by our brand partners, athletes, and creators. It is not medical advice, and it does not create a doctor-patient or other professional relationship. Our team members and partners are not your doctors. Do not ignore or delay professional medical advice because of anything you read or hear from us.

3.3 Talk to your doctor before use. Talk to a licensed physician before you use any Product, and especially if you:

  • (a) have, or think you may have, any medical condition, including a heart, liver, kidney, prostate, thyroid, or blood-pressure condition, high cholesterol, a blood-clotting disorder, a mood disorder, or any condition affected by hormones;
  • (b) take any prescription or over-the-counter medicine, including testosterone or other hormone therapy, blood thinners, or medicine for blood pressure, cholesterol, diabetes, or mental health;
  • (c) plan to have surgery; or
  • (d) use other dietary supplements.

We recommend regular checkups, including blood work, with your doctor before, during, and after your use of our Products.

3.4 Use only as directed. Follow all label directions and warnings, including the serving size, how long to use a Product, and any recommended break between uses. Do not take more than the recommended serving. Combine Products only as shown on our labels or website, or as your doctor approves. Do not use our Products with SARMs, or with anabolic steroids or other drugs that were not prescribed for you. If you take prescribed testosterone or other hormone therapy, use a Product only if its label allows it and your doctor approves. Do not use a Product if its safety seal is broken or missing, or after its expiration date. Store Products as the label directs, and keep all Products out of the reach of children.

3.5 Who should not use our Products. Do not use our Products if you:

  • (a) are under 18;
  • (b) are pregnant or nursing, or are trying to conceive a child;
  • (c) have been told by a doctor not to use them or similar products; or
  • (d) are subject to drug testing for sports, employment, or military service, unless you have first confirmed that every ingredient is permitted (see Section 3.6).

3.6 Athletes, drug testing, and military service members. Some of our Products contain ingredients that are prohibited or restricted by the World Anti-Doping Agency (WADA), the U.S. Anti-Doping Agency (USADA), the NCAA, professional sports leagues, and military drug-testing programs. Using these Products may cause a positive drug test. If you compete in a tested sport, serve in the military, or are subject to drug testing for any other reason, do not use any Product until you have confirmed with your sport's governing body, your testing authority, or your command that every ingredient on its label is permitted. You are responsible for any consequences of a positive test caused by an ingredient listed on the label.

3.7 Results vary. Results vary from person to person. They depend on many factors, including your age, health, genetics, diet, training, sleep, and how closely you follow the directions. We do not promise or guarantee any specific result.

3.8 Product information and labels. We try to describe our Products accurately, but formulas, packaging, and labels can change. Always read the label on the Product that you receive before you use it. The Supplement Facts panel on that label is the official statement of the Product's ingredients and amounts. If the label differs from information on the Services, follow the label and contact us with any questions. Check the label for allergen information. Colors and images on your screen may not match the actual Product.

3.9 Side effects and adverse event reports. Stop using a Product and contact a doctor right away if you have any side effect or unusual reaction. In an emergency, call 911. Please also report any adverse reaction to us at +1 (435) 266-0531 or info@vintage-muscle.com, so that we can record it and report it to the FDA when the law requires. You may also report directly to the FDA MedWatch program at www.fda.gov/medwatch or 1-800-FDA-1088.

3.10 Assumption of risk. You understand that all dietary supplements carry some risk, that people react differently to them, and that our labels describe known risks and warnings. You choose whether to use our Products. To the fullest extent permitted by law, you assume the risks of that use, including risks that come from not following the label, from using Products against medical advice, or from combining Products with other products, drugs, or substances. This Section does not limit our responsibility for a defective Product or for our own negligence.

4. Legal Restrictions, Personal Use, and Export

4.1 Laws vary by place. Laws about dietary supplements and their ingredients differ from state to state and from country to country, and they change. Some states restrict the sale of certain supplements to minors. Some countries ban or restrict certain ingredients that are found in dietary supplements, including some of the ingredients that we use, or require a prescription or an import permit for them. You are responsible for knowing and following the laws that apply where you live and where you receive Products. Do not order Products if it is unlawful for you to buy, import, possess, or use them.

4.2 Restricted locations. We may refuse, limit, or cancel orders to any state, country, or address where we believe, in our discretion, that the sale, shipment, or use of a Product may be unlawful or may carry unreasonable legal risk. We may also limit which Products we sell in particular places. If we cancel an order for this reason, we will refund the amount that you paid.

4.3 Personal use only; no resale. We sell Products only to end users for their personal use. You may not resell, distribute, or export Products, or list them on any marketplace (such as Amazon, eBay, or Walmart Marketplace) or on social media, without our prior written permission. We may refuse or cancel orders that we believe are placed for resale, including orders from dealers, resellers, distributors, or freight forwarders.

4.4 Unauthorized sellers. We cannot make sure that Products sold by anyone other than us are authentic, fresh, or in good condition. Such Products may be counterfeit, expired, mishandled, or tampered with. Our 30-Day Money-Back Guarantee and our other commitments in these Terms apply only to Products that you buy directly from us.

4.5 Export controls and sanctions. You must comply with all U.S. export control and economic sanctions laws. We do not knowingly sell or ship to any country or region that is subject to comprehensive U.S. sanctions or embargoes, or to any person on a U.S. government restricted-party list, such as the Specially Designated Nationals list of the Office of Foreign Assets Control. When you place an order, you represent that you are not such a person and that you will not export, re-export, or transfer Products in violation of these laws.

5. Accounts

5.1 Your account. You may need an account to use some features of the Services, such as managing AutoShip. You agree to give us accurate, current, and complete information and to keep it up to date. You are responsible for keeping your login details confidential and for all activity under your account. Tell us right away at info@vintage-muscle.com if you believe that someone has used your account without your permission.

5.2 One account per person. Do not create more than one account, share your account, or create an account for someone else unless we agree. Do not use false or different names, email addresses, phone numbers, or addresses to get more than one discount, Promotion, or refund under the Guarantee.

6. Orders, Prices, and Payment

6.1 How orders work. When you place an order, you offer to buy the Products in your cart at the prices shown at checkout. The order confirmation that we send only confirms that we received your order. It does not mean that we accepted it. We accept your order, and a contract of sale forms, when we ship the Products to you.

6.2 Our right to refuse or cancel orders. We may refuse or cancel any order, or any part of an order, before we ship it, for any lawful reason. Reasons include suspected fraud or unauthorized payment; suspected resale or abuse of a Promotion; our inability to verify your age or identity; errors in price, description, or availability; legal restrictions on shipping to your location; and quantity limits. If we cancel an order after we charge you, we will refund the amount charged for the cancelled items. We will try to notify you at the email address, phone number, or address that you gave us.

6.3 Quantity limits. We may limit quantities per person, household, account, payment method, or shipping or billing address, and per order or time period.

6.4 Prices and pricing errors. All prices are in U.S. dollars. Prices and availability may change at any time without notice. A price change will not affect an order that you have already placed, except as this Section allows for errors. Despite our efforts, a Product may sometimes be listed at an incorrect price or with incorrect information. If we find an error before we ship your order, we may cancel the order and refund you, or contact you to ask whether you want the order at the correct price. We do not adjust the price of past orders for later price drops or Promotions.

6.5 Taxes. We collect sales tax and other taxes where the law requires. You are responsible for any other taxes, duties, or fees that apply to your purchase, including import duties on international orders.

6.6 Payment. You must use a payment method that you are authorized to use. You authorize us and our payment processors to charge your payment method for the full amount of your order, including shipping and taxes, and, for AutoShip, for each recurring charge described in Section 10. Third-party payment processors handle your payments, and we do not store your full card number. Charges will appear on your statement under a name that identifies Vintage Muscle or Van Yperen Sites LLC. If you use a third-party payment option (such as Shop Pay, PayPal, or a buy-now-pay-later provider), that provider's terms also apply.

6.7 Billing disputes and chargebacks. If you have a problem with a charge, please contact us first at info@vintage-muscle.com. We can usually fix the problem faster than your bank can. If you dispute a charge with your bank or card issuer, we may give them information about your order, including order and delivery records, records that show that you agreed to these Terms (such as the date, time, IP address, and checkout details), and our communications with you. While a dispute is pending, we may pause your AutoShip and decline new orders from your account. If a dispute is decided in your favor after we have already refunded or replaced the order, you agree to return the duplicate amount to us. Nothing in this Section limits your rights under the Fair Credit Billing Act or other applicable law.

6.8 Changes and cancellations by you. If you want to change or cancel an order, contact us as soon as possible. We will try to help, but after we process or ship an order, we may not be able to change or cancel it. Section 9 applies to orders that have shipped.

7. Promotions, Discounts, and Gift Cards

7.1 Promotions and discount codes. Promotions, discount codes, bundle prices, and free-gift offers ("Promotions") are subject to the terms shown with them and to these Terms. Unless a Promotion states otherwise: (a) you may use one discount code per order; (b) Promotions cannot be combined; (c) Promotions have no cash value and cannot be transferred, sold, or exchanged; (d) Promotions cannot be applied to past orders; and (e) a Promotion ends on its stated end date or when we end it. We may change or end any Promotion at any time, but a change will not affect an order that you have already placed. We do not offer Promotions where the law prohibits them. Free gifts depend on availability, and we may substitute an item of equal or greater value.

7.2 Promotion abuse. If we believe that a Promotion was obtained or used through fraud, through multiple accounts or false identities, by a reseller, or in violation of its terms, we may cancel the affected orders before they ship, void the Promotion, or close the accounts involved.

7.3 Returns from promotional orders. If you return some items from an order that used a Promotion (for example, "buy 2, get 2 free"), we will recalculate the order as if you had bought only the items that you keep, at the prices that apply without the Promotion. Your refund will be the amount that you paid minus that recalculated total. Free gifts must be returned with the order, or we will deduct their regular price from your refund. If a return brings your order below a free-shipping threshold, we may deduct the standard shipping charge from your refund. This Section 7.3 does not reduce a refund under the Guarantee, which Section 9.1(d) governs.

7.4 Gift cards and store credit. You can redeem gift cards only for Products on our website. Gift cards that you buy from us do not expire, and we do not charge fees on them. Gift cards cannot be redeemed for cash, refunded, or reloaded, except where the law requires. Promotional gift cards or credits that we give away for free may have an expiration date, which we will show when we issue them. Treat gift cards like cash. Except where the law requires otherwise, we are not responsible for lost or stolen gift cards or for their unauthorized use. We may void gift cards obtained through fraud. Store credit that we issue works like a gift card unless we tell you otherwise.

7.5 Contests, giveaways, and rewards programs. Contests, sweepstakes, and giveaways are governed by their official rules. Any rewards, loyalty, referral, or affiliate program that we offer is governed by its own program terms. Points, referral credits, and similar benefits have no cash value unless the program terms state otherwise.

8. Shipping and Delivery

8.1 Where we ship. We ship to the locations that are available at checkout, subject to Sections 4 and 21. We may change these locations at any time.

8.2 Processing and delivery times. Most orders ship within 2 to 3 business days after we receive them. We will ship your order within 7 business days after we receive it (not counting weekends and U.S. holidays), unless we state a different time at checkout or notify you of a delay under Section 8.3. We ship with carriers such as USPS, UPS, and FedEx. Delivery times shown at checkout or by a carrier are estimates, not guarantees, unless we expressly state a guaranteed delivery date. We will email you tracking information when your order ships.

8.3 Shipping delays. If we cannot ship your order within the time that we stated, or within 30 days if we did not state a time, we will notify you before that time ends and give you the choice to accept the delay or to cancel the order and receive a full refund for the items that have not shipped, as the FTC Mail, Internet, or Telephone Order Merchandise Rule requires. If you cancel, we will refund you within the time that the Rule requires.

8.4 Backorders and pre-orders. If a Product is backordered or offered for pre-order, we will show its expected ship date. You may cancel a backordered or pre-ordered item at any time before it ships and receive a full refund of any amount you paid for that item.

8.5 Your shipping address. You are responsible for giving us a complete and accurate shipping address. We are not responsible for an order that is delivered to the address you gave us. If a package comes back to us as undeliverable, refused, or unclaimed, we will refund the price of the Products minus the original shipping charge and any return shipping cost that we pay, unless you ask us to reship the package at your cost. This does not apply to a package that you refuse at our request under Section 10.7.

8.6 Adult signature deliveries. Where the law requires it, or where we choose to require it, an adult must sign for your package and show valid government-issued photo ID. Some carriers require the person who signs to be 21 or older. If no eligible adult is available, the carrier may hold or return the package, which can delay delivery. If the package comes back to us, Section 8.5 applies.

8.7 Title and risk of loss. We ship all Products under a shipment contract. Title to the Products and risk of loss pass to you when we deliver the Products to the carrier.

8.8 Lost or stolen packages. If your package is lost in transit, contact us at info@vintage-muscle.com within 30 days after the ship date. If your Products arrive damaged, Section 9.3 applies. If tracking shows that your package was delivered but you did not receive it, contact us within 7 days after the delivery date. We will work with you and the carrier to resolve the problem. A resolution may include a replacement or a refund, at our discretion. We are not required to replace or refund a package that tracking shows was delivered to the address you gave us. If you buy shipping protection at checkout, its terms also apply.

8.9 International orders. Section 21 also applies to orders that we ship outside the United States.

9. Returns, Refunds, and Our 30-Day Money-Back Guarantee

9.1 30-Day Money-Back Guarantee. We want you to try our Products with confidence. If you are not satisfied with a Product the first time you buy it from us, you can return the first bottle (or other single unit) for a refund, even if you opened or used it. These conditions apply (together, the "Guarantee"):

  • (a) Time limit. You must contact us within 30 days after the delivery date shown by the carrier.
  • (b) First purchase, first unit. The Guarantee covers one unit (for example, one bottle) of each Product, the first time you buy that Product from us. It applies once per Product, per customer, and per household. For the Guarantee, each different formula is a separate Product, even when it is sold in a bundle or kit. You may return other units from that order only if they are unopened, under Section 9.2. Later orders of the same Product, including AutoShip renewals, are not covered by the Guarantee.
  • (c) Return the unit. You must return the unit, even if it is opened, partly used, or empty, with its label, within 14 days after we approve your request. Follow the steps in Section 9.4.
  • (d) What we refund. We refund the price that you paid for that unit, after any discounts, to your original payment method. If you bought the unit in a bundle or under a Promotion, its price is its proportional share of the total that you paid for the Products in that bundle or Promotion, based on their regular prices. We do not refund original shipping charges or return shipping costs. If we give you a prepaid return label, we deduct its cost from your refund.
  • (e) Exclusions. The Guarantee does not cover Products bought from anyone other than us, gift cards, free items, or requests that we reasonably believe are abusive, such as a pattern of excessive returns or repeated Guarantee requests under different names, accounts, email addresses, or shipping addresses.

9.2 Standard returns. For any order or unit that the Guarantee does not cover, you may return Products that are unopened, unused, sealed, and in their original packaging, if you contact us within 30 days after the delivery date. We refund the price that you paid for the returned Products, subject to Section 7.3. We do not refund original shipping charges or return shipping costs. If we give you a prepaid return label, we deduct its cost from your refund. For health and safety reasons, we cannot accept opened Products under this Section 9.2, except as Section 9.3 provides.

9.3 Damaged, defective, or incorrect items. If a Product arrives damaged or defective, or if we send you the wrong item, contact us within 30 days after delivery with your order number and photos of the Product, its label, and its packaging. We will replace the item (subject to availability) or refund it, including any shipping charge for that item. We may ask you to return the item at our cost or to dispose of it. Exchanges are available only for the same Product, and only when the item arrived damaged or defective.

9.4 How to return a Product. Before you send anything, email info@vintage-muscle.com with your order number and the reason for your return. We will send you a return authorization and the return address. We may refuse returns that are sent without our authorization or that are sent to a manufacturer. You pay return shipping unless Section 9.3 applies. For returns worth more than $50, use a trackable shipping service or buy shipping insurance. We are not responsible for return packages that we do not receive.

9.5 Refunds. When we receive and inspect your return, we will email you to tell you whether we approved your refund. We issue approved refunds to your original payment method within 7 business days after we receive and inspect the return. Your bank or card issuer may need more time to post the refund to your account. If you paid with a gift card or store credit, we refund to a gift card or store credit.

9.6 Items we cannot accept for return. Except where the law requires otherwise, we cannot accept: (a) opened Products, except under Section 9.1 or 9.3; (b) Products that you ask to return more than 30 days after delivery; (c) gift cards; (d) Products bought from anyone other than us; or (e) Products damaged by misuse, improper storage, or tampering after delivery.

9.7 AutoShip orders. Sections 9.1 through 9.6 apply to AutoShip orders. Your first AutoShip order of a Product counts as your first purchase of that Product under the Guarantee. If you were charged for an AutoShip delivery that you meant to cancel, contact us within 30 days after delivery. You may return the unopened Products for a refund under Section 9.2, and we will cancel your AutoShip if you ask. Section 10.7 explains what happens if we charge you after you cancel.

9.8 Refunds and chargebacks. You may not receive a refund from us and also recover the same amount through a chargeback or payment dispute. Section 6.7 applies.

9.9 Your other rights. This Section 9 does not limit any right that you have under applicable law that cannot be waived by contract, including the rights of consumers described in Section 21.

10. AutoShip Subscriptions (Automatic Renewal Terms)

AUTOSHIP RENEWS AUTOMATICALLY. IF YOU START AN AUTOSHIP SUBSCRIPTION, WE WILL CHARGE YOUR PAYMENT METHOD FOR EACH SCHEDULED DELIVERY UNTIL YOU CANCEL. YOU CAN CANCEL ONLINE AT ANY TIME.

10.1 How AutoShip works. AutoShip is our subscription program. When you choose AutoShip, we send the Products that you select at the delivery frequency that you choose at checkout (for example, every 8 weeks), and we charge you for each delivery. Your AutoShip continues until you cancel it or we cancel it under these Terms. There is no minimum number of orders unless the offer that you accept clearly states one at checkout.

10.2 Your consent to recurring charges. Before you start an AutoShip, we show you its key terms at checkout, including the Products, the price of each delivery, how often you will be charged, how long any discount lasts, and how to cancel. When you select AutoShip and complete checkout, you give your express consent to these terms. You also authorize us and our payment processors to charge your payment method, without further action by you, for each scheduled delivery, on or about each scheduled charge date, until you cancel. Each charge will be the AutoShip price then in effect, plus applicable shipping and taxes. The first charge occurs when you place your order. We may use updater services from card networks to get your new card details if your card changes. You can change your payment method in your account at any time. After you sign up, we will send you a confirmation email that includes your AutoShip terms and explains how to cancel.

10.3 AutoShip pricing and discounts. The price of each AutoShip delivery is shown at checkout and in your account. If an AutoShip discount or promotional price lasts only for a set number of deliveries or a set time, we will tell you this when you sign up or accept the offer, and the regular AutoShip price will apply after the discount ends. We will notify you at least 7 days, and no more than 21 days, before the first charge at the regular price.

10.4 Price changes. We may change the price of Products sold through AutoShip. We will notify you by email at least 10 days, and no more than 30 days, before a higher price applies to your next charge. The notice will explain how to cancel. If you are charged a higher price that you did not want, contact us within 14 days after the charge. We will cancel your AutoShip if you ask, and we will refund that charge in full if the order has not shipped, or if you return the order unopened (we will pay the return shipping).

10.5 Reminders and notices. We will email you:

  • (a) a reminder at least 7 days before each AutoShip charge, with the charge date, the amount, and how to skip, change, or cancel;
  • (b) for any AutoShip with more than 45 days between charges, a notice at least 30 days, and no more than 60 days, before each charge, with the charge date, the total charge, and how to cancel;
  • (c) a confirmation after each charge;
  • (d) a reminder of your AutoShip terms, including how to cancel, at least once a year; and
  • (e) any other notice that the law requires, including the notices described in Sections 10.3 and 10.4.

We send these emails to the email address on your account, so please keep it current.

10.6 Managing your AutoShip. At any time, you can skip, delay, or reschedule a delivery, swap Products, change quantities or your delivery frequency, and update your shipping address or payment method. To do this, log in to your account on our website and open your subscription settings, or contact us. Changes that you make before a charge is processed apply to that charge. Later changes apply to the next charge.

10.7 How to cancel. You can cancel your AutoShip at any time by any of these methods:

  • (a) Online: log in to your account on our website, open your subscription settings, and select the cancel option. Online cancellation takes effect right away.
  • (b) Email: send a cancellation request to info@vintage-muscle.com from the email address on your account, or include your name and order number.
  • (c) Phone: call +1 (435) 266-0531 during customer support hours (12:00 p.m. to 6:00 p.m. Mountain Time, Monday through Friday).

To avoid your next charge, cancel before your next scheduled charge date. We process email and phone requests within one business day. If we charge you after you cancel, including because we had not yet processed your email or phone request, contact us and we will refund that charge in full. If that order has already shipped, we may ask you to refuse the delivery or return the order unopened at our cost. We will email you a confirmation when your cancellation is complete. Cancelling stops future charges. It does not refund past charges, except as Sections 9 and 10.4 provide. Cancelling your AutoShip does not close your account.

10.8 Offers when you cancel. When you cancel online, we may show you an optional offer, such as a discount or a product swap. You never have to accept an offer to cancel. Every offer screen shows a clearly labeled "Click to cancel" button. When you click it, your AutoShip is cancelled, without any further offers. If you accept an offer, we will show you its price and terms before you accept, and we will confirm them by email.

10.9 Failed payments. If a charge fails, we may try the charge again (consistent with card network rules), ask you to update your payment method, and delay your delivery until payment succeeds. If we cannot collect payment after reasonable attempts, we may pause or cancel your AutoShip. We do not charge late fees. You remain responsible for any amount that you owe for Products that we have shipped.

10.10 Out-of-stock and discontinued Products. If a Product in your AutoShip is out of stock, we may delay that Product, ship the rest of your order, or skip that delivery, and we will tell you. We will not substitute a different product without your consent, but we may ship an updated version of the same Product. If an update changes the ingredients or their amounts, we will email you before we ship it. If we discontinue a Product, we will notify you and remove it from your AutoShip. We will not charge you for Products that we cannot ship.

10.11 Prepaid plans. If we offer a prepaid AutoShip plan, you pay in advance for a set number of deliveries. Unless you cancel, the plan renews at the end of the prepaid term for the same term, at the price then in effect, and we will notify you before it renews as Section 10.5 and the law require. If you cancel a prepaid plan, we will refund the amount that you paid for deliveries that have not shipped.

10.12 Changes to the AutoShip program. We may change or end the AutoShip program, or cancel your AutoShip, at any time. If we make a material change to your AutoShip terms, we will notify you before the change applies to you and explain how to cancel. If we cancel your AutoShip, we will not charge you for any delivery after the cancellation.

11. Text Message (SMS) Program Terms

11.1 Program description. The Vintage Muscle text message program (the "SMS Program") sends recurring automated marketing text messages, such as offers, product news, cart reminders, and Promotions. If you choose, we may also send you account and order texts, such as order, shipping, and AutoShip updates.

11.2 Consent. When you enter your mobile number and check the box or submit the sign-up form, or when you text a keyword to our number, you agree to receive recurring automated marketing text messages from Vintage Muscle at the number you provided, including messages sent with automated technology. Consent is not a condition of any purchase. You confirm that you are the account holder for that number, or that you have the account holder's permission to enroll it, and that you are at least 18 years old.

11.3 Message frequency and costs. Message frequency varies. Message and data rates may apply. Your mobile carrier may charge you for messages that you send and receive.

11.4 How to stop texts. Reply STOP to any message to stop receiving texts. We also honor these keywords: QUIT, END, REVOKE, OPT OUT, CANCEL, UNSUBSCRIBE, and STOP ALL. You may also opt out by any other reasonable means, such as by emailing info@vintage-muscle.com or calling us. After you opt out, we may send one text that confirms your request. After that, you will not receive marketing texts from us unless you sign up again. We will honor your request promptly, and always within the time that the law requires. Opting out of marketing texts stops all marketing texts from us. If you also receive account or order texts, reply STOP to one of those messages to stop them too.

11.5 Help. For help, reply HELP to any message, email info@vintage-muscle.com, or call +1 (435) 266-0531.

11.6 Carriers. Carriers are not liable for delayed or undelivered messages. We do not guarantee that any message will be delivered.

11.7 Changing your number. If you change or give up your mobile number, text STOP to us from that number first, or tell us right away so that we can remove it. You agree to tell us about any change to your mobile number.

11.8 Privacy. We will not share or sell your mobile number, your text message opt-in data, or your consent with any third party for that third party's own marketing purposes. We share this information only with service providers that help us run the SMS Program. Our Privacy Policy gives more details.

11.9 Changes and disputes. We may change or end the SMS Program at any time. Section 22 applies to any Dispute about text messages, including any claim under the Telephone Consumer Protection Act or a similar state law.

11.10 Email marketing. If you sign up for marketing emails, you can unsubscribe at any time with the link in any marketing email. We may still send you emails about your orders, your account, and your AutoShip.

12. Electronic Communications and Customer Support

12.1 Consent to electronic records. You agree that we may give you these Terms and any notices, disclosures, receipts, and other communications electronically, by email, by text, or by posting them on the Services. These electronic communications satisfy any legal requirement that a communication be in writing. To receive and keep them, you need a device with internet access that can display email and web pages. You may ask us for a paper copy at no charge. You may withdraw your consent to electronic communications by contacting us, but we may then need to close your account and cancel your AutoShip.

12.2 Keep your contact information current. You are responsible for keeping the email address, phone number, and mailing address on your account and orders accurate.

12.3 Call recording. If we record or monitor a call with you, we will tell you at the start of the call.

12.4 Automated tools and artificial intelligence. We may use automated tools, including generative artificial intelligence (AI), to help answer questions by chat, email, or text. If you ask whether you are communicating with a person or with AI, we will tell you. Automated responses may contain errors, and they are not medical advice. If an automated response conflicts with these Terms, with a product label, or with a written confirmation from a member of our team, the Terms, the label, or the written confirmation controls.

13. Reviews, Testimonials, and Endorsements

13.1 Your right to post honest reviews. We welcome honest reviews, whether they are positive, negative, or neutral. Nothing in these Terms restricts your right to write or share an honest review or other assessment of our Products, our Services, or our conduct. We will not penalize you, or threaten legal action against you, for an honest review.

13.2 How we moderate reviews. We publish reviews of all ratings. We may decline to publish, or may remove, a review or other content only for reasons that we apply in the same way to positive and negative content. For example, we may decline to publish or remove content that:

  • (a) is unlawful, defamatory, harassing, abusive, threatening, obscene, vulgar, or sexually explicit;
  • (b) is discriminatory or otherwise inappropriate with respect to race, sex, sexuality, ethnicity, or another intrinsic characteristic;
  • (c) contains another person's personal information, or confidential information or trade secrets;
  • (d) is unrelated to our Products, our Services, or your experience as a customer;
  • (e) is clearly false or misleading, including a statement that a Product diagnoses, treats, cures, or prevents a disease;
  • (f) infringes someone else's rights;
  • (g) contains viruses, spam, links, or advertising; or
  • (h) we reasonably believe is fake, was not written by a real customer, or was written by our employees, agents, or competitors.

We may verify purchases and label reviews from verified buyers. We do not edit reviews in a way that changes their meaning.

13.3 Incentives for reviews. If we offer you anything of value for writing a review, such as a discount, points, or a free Product, the incentive will not depend on whether your review is positive or negative. You must clearly disclose in your review that you received the incentive, and we may add that disclosure ourselves.

13.4 License to your content. "User Content" means any review, comment, rating, photo, video, or other content that you submit to us or through the Services. You keep ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, copy, display, publish, distribute, translate, and adapt your User Content (for example, to fit a format or length, without changing its meaning) in any media, including on the Services and in our marketing, and to display it with the name or username and location that you submitted with it. We will not use your face, voice, or likeness in paid advertising without your separate permission. We are not required to use any User Content.

13.5 Your responsibilities for content you submit. Your User Content must be truthful, must describe your own experience, and must not violate the law or anyone's rights. You represent that you own your User Content or have permission to share it, and that every person shown in your photos or videos agreed to be shown. Do not submit content that claims a Product treats or cures a disease, that contains another person's personal information, or that impersonates anyone. You are responsible for your User Content.

13.6 Testimonials and individual results. Reviews and testimonials on the Services describe the experiences of the people who gave them. Your results may be different. A review or testimonial is not a promise or guarantee of any result.

13.7 Brand partners, athletes, affiliates, and creators. Some people who appear in our content or who promote our Products, including brand partners, athletes, creators, and affiliates, are paid by us, receive free Products, or earn commissions on sales. We require them to clearly disclose their connection to us. Our affiliate and creator programs have their own terms.

13.8 Ideas and feedback. If you send us ideas, suggestions, or other feedback (other than User Content, which Section 13.4 covers), you agree that we may use that feedback for any purpose, without paying you and without keeping it confidential, under a non-exclusive, perpetual, irrevocable, royalty-free license. Do not send us confidential information.

14. Intellectual Property

14.1 Our content and trademarks. The Services and all content on them, including text, graphics, logos, product names, label designs, photos, videos, audio, software, and the selection and arrangement of these items, are owned by or licensed to Vintage Muscle. Copyright, trademark, trade dress, and other laws protect them. Vintage Muscle, our logos, and our product names and designs are our trademarks or trade dress. Other trademarks belong to their owners. Nothing in these Terms gives you any right to use our trademarks.

14.2 Your limited license. Subject to these Terms, we give you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use, including to shop for and buy Products.

14.3 Restrictions. Without our prior written permission, you may not:

  • (a) copy, reproduce, modify, distribute, sell, publicly display, or create derivative works from any part of the Services or their content;
  • (b) use our trademarks, product images, or content in any advertisement, website, marketplace listing, or social media account;
  • (c) frame or mirror the Services;
  • (d) use any robot, scraper, crawler, or other automated means to access, copy, or collect content or data from the Services, except that public search engines may index the Services as our robots.txt file allows;
  • (e) use any content from the Services to train, test, or improve artificial intelligence or machine-learning models, or to build datasets; or
  • (f) reverse engineer, decompile, or try to discover the source code of any part of the Services, except as the law expressly permits.

14.4 Copyright complaints (DMCA). We respect intellectual property rights. If you believe that content on the Services infringes your copyright, send our Copyright Agent a written notice that includes:

  • (a) your physical or electronic signature;
  • (b) identification of the copyrighted work that you claim is infringed;
  • (c) identification of the material that you claim is infringing and where it appears on the Services, with enough detail for us to find it;
  • (d) your name, address, phone number, and email address;
  • (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • (f) a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

Send notices to: Copyright Agent, Van Yperen Sites LLC, 909 South Main Street, Suite F, Logan, Utah 84321, USA; email: info@vintage-muscle.com; phone: +1 (435) 266-0531. If you knowingly misrepresent that material is infringing, you may be liable for damages under 17 U.S.C. § 512(f).

14.5 Counter-notices. If we remove content that you posted because of a copyright notice, and you believe that it was removed because of a mistake or misidentification, you may send our Copyright Agent a counter-notice that includes:

  • (a) your physical or electronic signature;
  • (b) identification of the removed material and the location where it appeared before it was removed;
  • (c) a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification; and
  • (d) your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.

We may restore the material 10 to 14 business days after we receive your counter-notice, unless the person who sent the original notice tells us that they have filed a court action.

14.6 Repeat infringers. We may terminate the accounts of users who repeatedly infringe the rights of others.

15. Prohibited Conduct

In addition to the other restrictions in these Terms, you may not use the Services or our Products to:

  • (a) break any law or regulation, or encourage anyone else to do so;
  • (b) buy Products for, or give Products to, anyone under 18, or resell or export Products in violation of Section 4;
  • (c) give false, inaccurate, or misleading information, impersonate anyone, or use a payment method or identity that you are not authorized to use;
  • (d) commit fraud, including false claims of non-delivery, damage, or dissatisfaction, disputes of valid charges, or abuse of Promotions, the Guarantee, returns, or accounts;
  • (e) get around, or try to get around, our age verification, location restrictions, or order limits;
  • (f) infringe or violate our intellectual property rights or the rights of anyone else, including privacy and publicity rights;
  • (g) harass, threaten, abuse, defame, or discriminate against our employees, customers, partners, or anyone else;
  • (h) upload or send viruses, malware, or any other harmful code;
  • (i) interfere with, disrupt, overload, or damage the Services; try to get unauthorized access to the Services, to other accounts, or to our systems; or probe, scan, or test the vulnerability of our systems without our permission (if you find a security issue, please report it to info@vintage-muscle.com);
  • (j) collect or harvest personal information about other people;
  • (k) send spam or unsolicited messages, or engage in phishing, pharming, pretexting, spidering, crawling, or scraping;
  • (l) post or send obscene, defamatory, or unlawful content; or
  • (m) misrepresent your relationship with us or claim to speak for us.

We may investigate violations, cooperate with law enforcement, suspend or terminate your access, cancel orders and AutoShip subscriptions, and take any other lawful action.

16. Third-Party Services and Links

16.1 Service providers. We use third parties to provide parts of the Services, such as our e-commerce platform, payment processing, subscription management, shipping, reviews, customer support, and marketing messages. Their services may be subject to their own terms and privacy policies.

16.2 Third-party links and tools. The Services may contain links to, or tools from, third parties that we do not control. We provide them only for your convenience, and we do not endorse them. We provide any third-party tool "as is" and "as available." We are not responsible for third-party websites, tools, content, products, or services, or for any harm or loss from your use of them. Your use of them is at your own risk and is subject to the third party's terms. Please direct any questions about a third-party product to that third party.

17. Privacy and Security

Our Privacy Policy explains how we collect, use, and share personal information. By using the Services, you acknowledge that you have read it. We use reasonable safeguards to protect your information, and payment card information is encrypted when it is sent to us. However, no website or internet transmission is completely secure.

18. Disclaimer of Warranties

18.1 EXCEPT FOR THE GUARANTEE AND THE OTHER REMEDIES IN SECTION 9, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, ALL CONTENT, AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. THE VINTAGE MUSCLE PARTIES DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES OF TITLE OR NON-INFRINGEMENT, OR WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.

18.2 WITHOUT LIMITING SECTION 18.1, WE DO NOT WARRANT THAT: (A) ANY PRODUCT WILL MEET YOUR EXPECTATIONS OR PRODUCE ANY PARTICULAR RESULT; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT; OR (D) ANY ERROR WILL BE CORRECTED. WE MAY REMOVE OR SUSPEND THE SERVICES AT ANY TIME.

18.3 General information. Information on the Services is for general information only. Some of it is historical and may not be current. We have no obligation to update information except as the law requires. You rely on the content of the Services at your own risk.

18.4 IF APPLICABLE LAW DOES NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, ANY IMPLIED WARRANTY APPLIES ONLY TO THE MINIMUM EXTENT, AND FOR THE SHORTEST TIME, THAT THE LAW REQUIRES. WE DO NOT DISCLAIM ANY IMPLIED WARRANTY THAT THE MAGNUSON-MOSS WARRANTY ACT DOES NOT ALLOW US TO DISCLAIM. SECTION 26 DESCRIBES HOW THIS SECTION 18 APPLIES TO RESIDENTS OF NEW JERSEY.

19. Limitation of Liability

19.1 TO THE FULLEST EXTENT PERMITTED BY LAW, THE VINTAGE MUSCLE PARTIES WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, SAVINGS, DATA, OR GOODWILL, OR FOR THE COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT, WHETHER BASED ON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.

19.2 TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE VINTAGE MUSCLE PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT WILL NOT BE MORE THAN THE GREATER OF: (A) THE AMOUNT THAT YOU PAID US FOR THE PRODUCT OR SERVICE THAT GAVE RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

19.3 EXCEPTIONS. SECTIONS 19.1 AND 19.2 DO NOT LIMIT LIABILITY FOR: (A) DEATH OR PERSONAL INJURY; (B) FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT; OR (C) ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING ANY RIGHT UNDER A CONSUMER PROTECTION LAW THAT CANNOT BE WAIVED.

19.4 Basis of the bargain. These limits reflect a reasonable allocation of risk between you and us, and they are an essential basis of our agreement. They apply even if a limited remedy fails of its essential purpose. Section 26 describes how this Section 19 applies to residents of New Jersey.

20. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Vintage Muscle Parties from and against all claims, demands, and actions brought by third parties, and all resulting losses, damages, liabilities, judgments, settlements, costs, and reasonable attorneys' fees, that arise out of or relate to: (a) your breach of these Terms; (b) your violation of any law or of any third party's rights; (c) your resale, distribution, or export of Products, or your provision of Products to any other person, including anyone under 18; (d) your User Content; or (e) your use of Products contrary to their labels or these Terms. This Section 20 applies only to claims brought by third parties. It does not apply to claims between you and us, which Section 22 governs. We may choose to control the defense of any claim for which you must indemnify us, at your expense, and you agree to cooperate with our defense. You may not settle any such claim without our written consent.

21. International Customers

21.1 U.S. focus. We operate the Services from Utah, in the United States, and we design them for customers in the United States. Our Products are labeled for the U.S. market and may not meet the requirements of other countries. We do not represent that the Services or Products are appropriate, lawful, or available outside the United States.

21.2 Imports, duties, and local laws. If you order Products for delivery outside the United States, you are the importer of record, and you must comply with all laws of the country of delivery, including laws that restrict or ban certain supplement ingredients or that require a prescription or import permit. You are responsible for all duties, taxes, customs fees, and brokerage charges. Except where Section 21.3 or 21.4 requires otherwise, we are not responsible for, and we do not refund, orders that customs or other authorities delay, seize, refuse, or destroy.

21.3 Consumers in the EU, the EEA, the UK, and Switzerland. If you are a consumer who lives in the European Union, the European Economic Area, the United Kingdom, or Switzerland:

  • (a) Nothing in these Terms limits the rights that you have under the mandatory consumer protection laws of the country where you live. Section 23 (Governing Law) applies only to the extent that it does not deprive you of those protections.
  • (b) Section 22 (arbitration, class action waiver, and jury trial waiver) does not apply to you. You may bring claims in the courts of the country where you live.
  • (c) You may withdraw from your purchase within 14 days after you receive the goods, without giving a reason, by sending us a clear statement of your decision (for example, by email to info@vintage-muscle.com). We will refund all payments that we received from you, including standard delivery charges, within 14 days after we receive your withdrawal notice. We may hold the refund until we receive the goods back or until you give us proof that you sent them. You pay the direct cost of returning the goods. This right does not apply to sealed goods that are not suitable for return for health-protection or hygiene reasons once they have been unsealed after delivery.
  • (d) You keep your statutory legal guarantee for goods that do not conform to the contract.
  • (e) Sections 18, 19, and 20 apply only to the extent that the mandatory laws of the country where you live allow.
  • (f) You may use the model withdrawal form below, but you do not have to.

Model withdrawal form (complete and return this form only if you wish to withdraw from the contract): To Van Yperen Sites LLC (Vintage Muscle), 909 South Main Street, Suite F, Logan, Utah 84321, USA, info@vintage-muscle.com: I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract of sale of the following goods (*): ____. Ordered on (*) / received on (*): ____. Name of consumer(s): ____. Address of consumer(s): ____. Signature of consumer(s) (only if this form is sent on paper): ____. Date: ____. (*) Delete as appropriate.

21.4 Other mandatory local laws outside the United States. If you live in a country or province outside the United States whose mandatory consumer protection laws give you rights that these Terms cannot override (for example, the Canadian province of Quebec), these Terms do not limit those rights, and Section 22 applies to you only to the extent that those laws allow.

22. Dispute Resolution: Binding Individual Arbitration, Class Action Waiver, and Jury Trial Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. IT REQUIRES YOU AND VINTAGE MUSCLE TO RESOLVE MOST DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND IT WAIVES YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO TAKE PART IN A CLASS ACTION. IN ARBITRATION, THERE IS NO JUDGE OR JURY, AND COURT REVIEW OF AN ARBITRATION AWARD IS LIMITED. YOU MAY OPT OUT OF THIS SECTION WITHIN 30 DAYS, AS SECTION 22.12 DESCRIBES.

22.1 Informal dispute resolution comes first. We want to address your concerns without a formal proceeding. Before either of us starts an arbitration or a court action about a Dispute (other than an action under Section 22.3(b) or 22.3(c)), the party with the claim must send the other party a written notice (a "Notice of Dispute") and try to resolve the Dispute informally for 60 days.

  • (a) A Notice of Dispute must include: the claimant's name, mailing address, email address, and phone number; any order number, and the email address and phone number linked to the claimant's account or orders; a description of the Dispute and the facts behind it; and the specific relief requested, including any amount of money. The claimant must sign it personally (and the claimant's lawyer must also sign it, if the claimant has one). A Notice of Dispute may concern only one claimant. If the party that receives a Notice of Dispute believes that it is incomplete, that party will say what is missing within 10 days after receiving it. If it does not, the Notice of Dispute is complete.
  • (b) You must send your Notice of Dispute by email to info@vintage-muscle.com with the subject line "Notice of Dispute," or by mail to Van Yperen Sites LLC, Attn: Legal - Notice of Dispute, 909 South Main Street, Suite F, Logan, Utah 84321, USA. We will send any Notice of Dispute to you at the email address or mailing address that we have for you.
  • (c) Within 60 days after a complete Notice of Dispute is received, either party may request an individual settlement conference by phone or video. If either party requests a conference, you and an authorized representative of Vintage Muscle will each take part personally (with your lawyers, if you have them) at a time that works for both of us.
  • (d) If the Dispute is not resolved within 60 days after a complete Notice of Dispute is received, either party may start an arbitration or, where these Terms allow, a court action (such as a small claims action under Section 22.3(a)).
  • (e) All statutes of limitation and filing-fee deadlines are paused (tolled) from the date that a complete Notice of Dispute is received until the end of the 60-day period. A court may enforce this Section 22.1, and the arbitration administrator may decline to accept an arbitration demand that is filed before this process is complete.

22.2 Agreement to arbitrate. Except as Section 22.3 states, you and Vintage Muscle agree to resolve every Dispute exclusively through final and binding arbitration on an individual basis. "Dispute" means any dispute, claim, or controversy between you and Vintage Muscle or any of the Vintage Muscle Parties that arises out of or relates in any way to these Terms or any earlier version of them, the Services, any Product, AutoShip, any purchase, advertising or marketing (including emails, text messages, and calls), privacy or data security, or any other part of your relationship with us. This includes Disputes based on contract, warranty, tort (including negligence, product liability, fraud, and misrepresentation), statute (including consumer protection and telephone consumer protection laws), regulation, ordinance, or any other legal or equitable theory, whether the Dispute arose before you accepted these Terms or arises later. This agreement to arbitrate does not apply to a Dispute that was already pending in court or in arbitration before you accepted these Terms. These Terms involve interstate commerce, and the Federal Arbitration Act (9 U.S.C. § 1 and following) governs the interpretation and enforcement of this Section 22.

22.3 Exceptions. The following do not have to be arbitrated:

  • (a) Small claims. Either party may bring an individual action in small claims court if the action qualifies for that court, stays in that court, and proceeds only on an individual basis. The action may be brought in the county where you live or in Cache County, Utah. Section 22.1 still applies first.
  • (b) Intellectual property. Either party may bring an action in court for injunctive or other equitable relief to stop the infringement or misuse of intellectual property rights.
  • (c) Sexual harassment and sexual assault. Any claim that you choose to bring in court under the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021.
  • (d) Public injunctive relief, to the extent that Section 22.7 provides.
  • (e) Consumers outside the United States, to the extent that Section 21.3 or 21.4 provides.

22.4 Who decides arbitrability. The arbitrator has exclusive authority to decide all issues about the interpretation, applicability, scope, enforceability, and validity of this Section 22, including whether a Dispute must be arbitrated. However, a court has exclusive authority to decide: (a) whether you and we formed an agreement to arbitrate; (b) whether the waiver in Section 22.6 is valid and enforceable; (c) whether Section 22.9 (Mass Arbitration) is valid and enforceable; and (d) whether a claim falls under Section 22.3(c).

22.5 Arbitration rules and administrator. The American Arbitration Association ("AAA") will administer the arbitration under its Consumer Arbitration Rules and, when they apply, its Mass Arbitration Supplementary Rules, in each case as in effect when the arbitration is filed (together, the "AAA Rules"), as this Section 22 modifies them. The AAA Rules are available at www.adr.org or by calling the AAA at 1-800-778-7879. If the AAA is unavailable or unwilling to administer the arbitration, the parties will agree on another arbitration provider, and if they cannot agree, a court will appoint one under 9 U.S.C. § 5. A single neutral arbitrator will decide the Dispute. The arbitrator must follow these Terms and applicable law. If the AAA Rules conflict with this Section 22, this Section 22 controls.

22.6 Class, collective, and representative action waiver. YOU AND VINTAGE MUSCLE AGREE THAT EACH OF US MAY BRING DISPUTES AGAINST THE OTHER ONLY IN OUR INDIVIDUAL CAPACITIES, AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY AWARD RELIEF (INCLUDING DECLARATORY OR INJUNCTIVE RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY THAT SEEKS RELIEF, AND ONLY TO THE EXTENT NEEDED TO PROVIDE RELIEF ON THAT PARTY'S INDIVIDUAL CLAIM. UNLESS YOU AND WE BOTH AGREE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF MORE THAN ONE PERSON, AND MAY NOT PRESIDE OVER ANY FORM OF CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, EXCEPT FOR THE ADMINISTRATIVE BATCHING DESCRIBED IN SECTION 22.9.

22.7 If the class action waiver is found unenforceable. If a court decides, after all appeals are exhausted, that applicable law prevents enforcement of any part of Section 22.6 for a particular claim or request for relief (such as a request for public injunctive relief), then that claim or request for relief, and only that one, will be severed from the arbitration and may be brought in court under Section 22.13. All other claims will be arbitrated individually. The severed claim or request for relief will be paused (stayed) until the individual arbitration is complete. A Dispute will never proceed as a class, collective, or representative arbitration.

22.8 Hearings, fees, and awards.

  • (a) Format and location. The arbitration will be conducted by video conference, by phone, or on written submissions, as the AAA Rules provide, unless the arbitrator decides that an in-person hearing is necessary. Any in-person hearing will take place in the county where you live, unless you and we agree on another place.
  • (b) Arbitration fees. The AAA Rules govern the payment of filing, administration, and arbitrator fees, and under them the business pays most of these costs. We will pay all AAA fees except the filing fee that the AAA Rules assign to you. If the arbitrator rules in your favor on any claim, we will reimburse your filing fee.
  • (c) Attorneys' fees and costs. Each party pays its own attorneys' fees and costs, unless the arbitrator awards them under applicable law or the AAA Rules. We will not seek our attorneys' fees or costs from you in arbitration unless the arbitrator finds that your claim was frivolous or was brought for an improper purpose. You may be represented by a lawyer of your choice.
  • (d) Remedies. The arbitrator may award any individual relief that a court could award under applicable law, subject to these Terms to the extent that they are enforceable.
  • (e) Decision and award. The arbitrator will issue a written decision that explains the essential findings and conclusions on which the award is based. The award is final and binding, subject only to the limited review that the Federal Arbitration Act allows, and judgment on the award may be entered in any court that has jurisdiction. An award has no preclusive effect in any proceeding that involves a person who was not a party to the arbitration.

22.9 Mass arbitration.

  • (a) If 25 or more Notices of Dispute or arbitration demands that raise similar claims are submitted against us by, or with the help of, the same or coordinated lawyers or organizations (a "Mass Filing"), the AAA Mass Arbitration Supplementary Rules and this Section 22.9 apply. Each claimant must still comply with Section 22.1.
  • (b) Batching. The AAA will administer the demands in a Mass Filing in batches of up to 100 claimants each, with any remainder in a final batch, unless the parties agree otherwise or the process arbitrator appointed under the AAA Rules decides that a different batch size is fairer and more efficient. Each batch will be assigned to one arbitrator, who will decide each claimant's claims individually. The result in one batch does not bind any claimant in another batch.
  • (c) Tolling. All statutes of limitation and filing-fee deadlines for a claimant's claims are paused (tolled) from the date that the claimant's complete Notice of Dispute is received until the claimant's batch is assigned to an arbitrator.
  • (d) Cooperation. The parties will work in good faith with the AAA to resolve a Mass Filing efficiently and to reduce its cost.
  • (e) Who decides. The process arbitrator appointed under the AAA Rules decides whether and how this Section 22.9 applies to particular demands. A court may enforce this Section 22.9, including by staying the filing or administration of arbitration demands that do not comply with it.
  • (f) If this Section 22.9 is found unenforceable, the Mass Filing will proceed under the AAA Rules, and each claim will still be arbitrated individually under Sections 22.2 and 22.6.

22.10 One-year time limit. To the extent permitted by law, you or we must start any claim or Dispute, by sending a Notice of Dispute under Section 22.1, within one year after the claimant knew or should have known of the claim, or the claim is permanently barred. This one-year limit does not apply to claims for death or personal injury, or where applicable law requires a longer period that cannot be shortened by agreement. Section 26 describes how this Section 22.10 applies to residents of New Jersey.

22.11 Jury trial waiver. IF FOR ANY REASON A DISPUTE PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND VINTAGE MUSCLE EACH WAIVE ANY RIGHT TO A JURY TRIAL, TO THE FULLEST EXTENT PERMITTED BY LAW.

22.12 Your right to opt out. You may opt out of this Section 22 by sending us written notice within 30 days after the date that you first accept a version of these Terms that contains this opt-out right. Send your opt-out notice by email to info@vintage-muscle.com with the subject line "Arbitration Opt-Out," or by mail to the address in Section 22.1(b). Your notice must include your name, your mailing address, the email address and phone number linked to your account or orders, and a clear statement that you want to opt out of arbitration. If you opt out, Sections 22.2 through 22.9 and Section 22.11 do not apply to you, and Disputes will be resolved in court under Section 22.13. Sections 22.1, 22.10, and 22.13 still apply to you. Your opt-out also applies to later versions of these Terms. Opting out does not affect any other part of these Terms.

22.13 Courts when arbitration does not apply. If a Dispute is not arbitrated (for example, because you opted out, because an exception in Section 22.3 applies, or because a claim is severed under Section 22.7), the Dispute will be decided exclusively by the state courts located in Cache County, Utah, or by the United States District Court for the District of Utah, and you and we consent to the personal jurisdiction of those courts. This Section 22.13 does not apply to a small claims action under Section 22.3(a), or where Section 21.3 or 21.4 gives you the right to bring claims in the courts where you live.

22.14 Changes to this Section 22. If we make a material change to this Section 22 (other than a change to our notice address or contact information), we will notify you by email at least 30 days before the change takes effect (or, if we do not have your email address, by a prominent notice on the Services). You may reject the change by sending us written notice, in the way that Section 22.12 describes, within 30 days after the change takes effect. If you reject the change, the version of this Section 22 that you last accepted will continue to apply to you. A change to this Section 22 will never apply to a claim that arose, or to a Dispute for which a Notice of Dispute was sent, before the change took effect.

22.15 Survival and severability. This Section 22 survives the end of these Terms, the closure of your account, and the end of your relationship with us. Except as Section 22.7 provides, if any part of this Section 22 is found unenforceable, the rest of this Section 22 remains in effect. If this Section 22 is found unenforceable in its entirety for a Dispute, that Dispute will be decided in court under Section 22.13.

23. Governing Law

The laws of the State of Utah govern these Terms and every Dispute, without regard to Utah's conflict-of-laws rules, except that the Federal Arbitration Act governs Section 22. The United Nations Convention on Contracts for the International Sale of Goods does not apply. This Section 23 does not deprive you of the protection of any law of the place where you live that cannot be waived by contract.

24. Termination and Suspension

24.1 By you. You may stop using the Services at any time. To cancel AutoShip, follow Section 10.7. To close your account, contact us.

24.2 By us. We may suspend or end your access to all or part of the Services, cancel orders or AutoShip subscriptions, or refuse service at any time, for any lawful reason, including if we believe that you violated these Terms or the law, engaged in fraud or abuse, or created a risk for us or others. If we cancel an order or an AutoShip delivery that you paid for and that we have not shipped, we will refund you for it.

24.3 Effect of termination. Termination does not affect any obligation or liability that arose before termination, including any amount that you owe. Every Section of these Terms that by its nature should survive termination will survive, including Sections 3, 4, 6.7, 9, 13, 14, and 18 through 27.

25. Changes to These Terms and the Services

25.1 Changes to these Terms. We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the "Last updated" date. If we make a material change, we will also notify you in advance by email if we have your email address, and otherwise by a prominent notice on the Services. Each change takes effect on the date stated in the notice, which will be at least 7 days after we post it, except that a change that the law requires, or that concerns a new feature, may take effect right away. Section 22.14 governs changes to Section 22.

25.2 Effect of changes. Except as Sections 22.2 and 22.14 provide, updated Terms apply only from their effective date. They do not apply to an order that you placed before that date. Each AutoShip charge is a new order placed on its charge date. Section 22.14 governs how a change to Section 22 applies to a Dispute.

25.3 Your choice. If you do not agree to updated Terms, stop using the Services and cancel any AutoShip before the changes take effect. If you use the Services, place an order, or let an AutoShip charge proceed after the changes take effect, you accept the updated Terms. Section 22.14 governs your right to reject a change to Section 22.

25.4 Changes to the Services. We may change, suspend, or discontinue any part of the Services or any Product at any time. We are not liable to you for doing so, except that we will refund any amount that you paid for Products that we do not ship.

26. State-Specific Terms

26.1 New Jersey residents. If you are a resident of New Jersey, Sections 3.10 (Assumption of Risk), 18 (Disclaimer of Warranties), 19 (Limitation of Liability), 20 (Indemnification), and 22.10 (One-Year Time Limit) apply to you only to the extent permitted by New Jersey law. If any of those provisions is held unenforceable, void, or inapplicable under New Jersey law, that provision will not apply to you, but the rest of these Terms will remain binding on you and on us. Nothing in these Terms limits your rights under the New Jersey Consumer Fraud Act.

26.2 California residents. Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice. The Services are provided by Van Yperen Sites LLC, doing business as Vintage Muscle, 909 South Main Street, Suite F, Logan, Utah 84321; phone +1 (435) 266-0531; email info@vintage-muscle.com. We do not charge any fee to use the Services. You pay only for the Products that you buy, plus shipping and taxes. To resolve a complaint about the Services, contact us as Section 28 describes. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.

26.3 Consumer protection laws. Nothing in these Terms waives or limits any right that you have under the Utah Consumer Sales Practices Act or under any other consumer protection law that cannot be waived by contract.

26.4 Other states. Some states do not allow the disclaimer of implied warranties, the exclusion or limitation of incidental or consequential damages, or limits on the time to bring a claim. If you live in one of those states, some of the limits in Sections 18, 19, and 22.10 may not apply to you. Section 26.1 states how these limits apply to residents of New Jersey.

27. General Terms

27.1 Entire agreement. These Terms, together with the policies and Additional Terms described in Section 1.3, are the entire agreement between you and us about their subject matter. They replace any earlier agreements between you and us about that subject matter, except as Sections 1.6 and 22.14 provide.

27.2 Assignment. You may not assign or transfer these Terms, or any of your rights under them, without our written consent. We may assign or transfer these Terms, including in connection with a merger, acquisition, or sale of assets, or by operation of law.

27.3 Events beyond our control. We are not responsible for any delay or failure caused by events beyond our reasonable control, such as natural disasters, severe weather, epidemics, supply shortages, disruptions in raw materials or manufacturing, government actions, carrier delays, labor disputes, power or internet failures, or cyberattacks. This Section 27.3 does not affect your right to cancel and receive a refund for an order that we cannot ship (Section 8.3).

27.4 Severability. If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the other provisions will remain in full force and effect, except as Section 22.7 provides.

27.5 No waiver. If we do not enforce a provision of these Terms, we do not waive our right to enforce it later. A waiver is effective only if it is in writing and signed by us.

27.6 Relationship of the parties. You and we are independent parties. These Terms do not create any partnership, joint venture, employment, or agency relationship.

27.7 Third-party beneficiaries. The Vintage Muscle Parties are intended third-party beneficiaries of Sections 18, 19, 20, and 22, and they may enforce those Sections. There are no other third-party beneficiaries of these Terms.

27.8 Interpretation. Headings are for convenience only and do not affect the meaning of these Terms. "Including" means "including without limitation." Words in the singular include the plural, and words in the plural include the singular.

27.9 Language. These Terms are written in English. If we provide a translation, the English version controls to the extent permitted by law.

27.10 Notices. We may give you notices by email, by text message, through your account, or by posting them on the Services. A notice to you is effective when we send or post it. Except as Section 22 provides, you may give us notice by email to info@vintage-muscle.com or by mail to the address in Section 28. A notice to us is effective when we receive it.

27.11 Electronic signatures. When you check a box, click a button, or take another electronic action to agree to these Terms, you sign them electronically, with the same effect as a handwritten signature.

27.12 Store platform. Our online store is hosted by Shopify Inc., which provides the e-commerce platform that lets us sell our Products to you. Shopify is not a party to these Terms.

27.13 Earlier versions. To ask for a copy of an earlier version of these Terms, contact us.
